Efficiency, Accountability, Politics and Corporate Governance: The four Reflections on Developing Administrative Corporation Institutions

行政法人是一種公私混合型的組織。這類組織型態係混合公部門與私部門的特質，其預算雖大部分來自政府的補助，卻不像一般行政機關受到政府較嚴密的監督控制，僅著重於適法性的監督，而大幅放寬或不再進行適當性之監督。台灣自2002年11月開始建置行政法人制度，歷經四年多的努力，在政治氣候不佳，以及對這項制度仍有諸多疑慮下，截至目前僅有國立中正文化中心完成行政法人化。本文試圖以效率、課責、政治與法人治理等四個面向，重新思考我國建置行政法人制度所需關注的問題，以及可預先完備化的基礎條件。

The administrative corporation is a kind of public-private hybrid organizations, to mix the features of public and private sectors is the pattern characteristic of institution. The administrative corporation as a public body with main financial support from and indispensable accountability by the government, but the controlled density is less the public agency by it. Since November 2002, the Executive Yuan, Republic of China (Taiwan) developed the administrative corporation institution, the past four years, to construct the new public body model is not smooth except the National Theater and Concert Hall, because of the somber atmosphere of the Taiwan politics and it has been many doubts. This paper try to reflect that the crux of the problem on developing administrative corporation institution in Taiwan from the dimensions of efficiency, accountability, politics and corporate governance.
