Institutional Choice between Agency and Administrative Body

政署（Agency）模式是英國文官體系一百五十年來革命性的改變。先進國家學習英國「政署化」（agencification）經驗的結果是，中央政府中類似政署的制度，約佔經濟合作發展組織國家中央政府50%到75%的公共預算和公務人力。
英國的政署和行政法人組織型態，在發展過程中，並不以單一、一致性規定的法律為行政組織建制的基礎，而採取逐步發展、隨時調整法律規範的作法，呈現務實、理性的結果。我國的法律體系比較固定僵硬，在行政組織調整方面，要求以法律為規範的基礎，缺乏彈性、容錯、不斷修正的逐步演化空間，和政署制度、行政法人制度的基本精神有所出入。
我國如果要採取行政組織多元化的途徑，應該學習英國的經驗，並融合、適應我國的政治文化和行政文化，優先考慮和傳統部會機關比較接近的政署模式。政署模式運作比較成熟之後，再行考慮採取行政法人的制度，是較佳的制度選擇。

Agency model developed and expanded in UK has greatly reshaped British public organizational format and civil service since 1980s. Agencification trend in the world has also dramatically changed the financial as well as civil service structure among OECD governments. British agency model and administrative body model are analyzed and compared. It is suggested that Taiwan should adopt the agency model first to avoid overt political influence in personnel appointment. No matter what kind of organizational model chosen, it is suggested that institutional standards and guidance be established.
