本文描述規則制定的國家與資本家進行諮商同意權行使的雙方，社會經濟地位以及階級上的具體差距，在國家和資本家規則下「下問」於權力和經濟能力皆低於自身的原住民族，揭示原住民族在國家體制內困於自決不足「迫於併入國家」的處境。本文認為當前國內政治運作下，自由、事先、知情同意原則成為「不自由、不事先、不知情，無法不同意原則」形同虛設，只剩程序參與。 This article describes the status and class gaps of the various actors in the exercise of the right of consultation, revealing that the indigenous are trapped in self-determination within the state system and are forced to merge into the country. It argues that under the current domestic political situation, the principle of free, prior and informed consent (FPIC) becomes “not free, not prior, uninformed, and cannot disagree.”
