Thepublicopinionenvironmentisanimportantcomponentofbusinessenvironment.ThecurrentdeterioratingpublicopinionenvironmentforenterprisesinChinaispartlyduetotheinsufficientjudicialremediesforgoodwill.Fromtheperspectiveofcomparativelaw,thesystemofrightofreplymayprovideasolutionforChina.Consideringthepotentialriskofabuseinthetransplantationofrightofreply,itmaybemoreap-propriatetotemporarilyreplaceitwithcommercialrightofreply.Asanewtypeofright,thecommercialrightofreplyisrootedintheprotectionsystemofpersonalityrights,essentiallyanaturalextensionandnecessarysupplementoftherighttoclaimpersonalityrights.Itisguidedbytheprincipleofsubstantiveequality,givingdueconsiderationtotheparticularityofcommercialactivities,andbasedonthetheoryofcivilself-defense,demonstratingstrongrationalityandlegality.Fromtheperspectiveofinterpretivism,thecommercialrightofreplycanbeaccommodatedbythecurrentlegalsystemandcanbeproventhroughappropriateinterpretationmethodsfromArticles995and1028oftheCivilCode.Thisoptimizationpathfollowsthebasicessenceofgradualreform,andwillfullydemonstratetheChinesewisdomoflocalruleoflawpractice. |
