部分請求正當化研究——程序視域下動態系統論的視角

Research on Partial Request Justification: A Perspective of Dynamic Systems Theory from the Program Perspective

關於部分請求問題，我國尚未形成統一的處理規則。在缺乏法律規定時，是否可以提起部分請求本質上是一個價值判斷問題。將動態系統論與程序思維相結合，構建程序視域下的動態系統論，可以為部分請求問題提供正當化指引。借鑒既有研究成果與規範性認知可以將是否可以提起部分請求的要素固定為原告善意程度、被告異議程度、原告過錯程度和被告對提起部分請求的“貢獻度”。程序視域下的動態系統論要求訴訟主體在訴訟過程中以平等對話的方式對上述四要素進行綜合的動態評價，平衡各方利益，達成是否可以提起部分請求的共識。
