個案分析遭偷渡兩國論及枉法適用的兩岸關係法制

Analysis of Cases Where Cross-Strait Relations Act and Regulations were Illegally Inserted into the ''Two-State Theory'' and Their Original Meaning was Distorted When Applied

本文針對2025年以來受媒體關注之有關兩岸關係法制的案件，分析如史雪燕任公職因「未放棄中共國籍」而遭解職、早已轉換身分為大陸地區人民卻收到服兵役通知、來臺定居多年後卻限期「補繳」所謂未繳的「喪失原籍證明之公證書」、臺籍張立齊在大陸申領定居證即遭廢止臺灣戶籍，以及高中應屆畢業生因在臺設有戶籍未滿二十年而遭撤銷報考國防醫學院的資格等，若非因民進黨政府將兩岸關係法制偷渡了兩國論，就是枉法適用兩岸關係法制的結果。本文最後指出，民進黨政府於2023年5月24日以「行政院秘書長函」通令各機關起，就開始以行政解釋將兩國論偷渡進兩岸關係法制中。而在賴清德總統上任後，更積極在處理個案時，以扭曲法規原意和行政解釋的方式達到實質修法的效果。因此，未來涉及兩岸關係事件的處理，政府行政行為違法違憲的情形勢將層出不窮。

This article analyzes several cases concerning cross-strait relations that have received media attention since 2025, demonstrating that the Democratic Progressive Party (DPP) government has illegally inserted the ''two-state theory'' into cross-strait regulations and deliberately distorted the original intent of the statutes when applying them. This article also emphasizes that the DPP government substantively amended the law through administrative interpretation starting May 24, 2023. Since President Lai Ching-te took office, he has actively dismantled existing laws based on the One-China principle. Consequently, illegal and unconstitutional administrative actions will continue to emerge.
