日本家庭暴力防治對策之現狀初探──以加害人的機構內矯正處遇為例

A Preliminary Study on the Current Status of Domestic Violence Prevention Strategies in Japan–An Illustrative Example of Institutional Correctional Treatment for Perpetrators

本文是因應本期主題「矯正機關家庭暴力加害人處遇」而撰寫，主要是介紹國外制度運用情形的文章。本文說明了日本針對家庭暴力防治所擬定的對策概況，並將重點放在加害人在機構內接受矯正處遇的實際情形。首先，介紹了家庭暴力的基本概念及專門法的誕生，闡明了相關用語及法律背景。接著，本文具體介紹了加害人在機構內接受矯正處遇的種類與內容，並特別關注了「改善指導」的運用與其變化。最後，以黑羽監獄為例，介紹了近年來實際的操作情形，並在結論部分進行了一些初步的觀察。

This article was written in response to the current issue theme, “The Treatment of Domestic Violence Perpetrators in Correctional Institutions,” and primarily introduces the implementation of foreign systems. It outlines the domestic violence prevention strategies developed in Japan, with a focus on the actual situation of perpetrators undergoing correctional treatment within institutions. First, the article introduces the basic concept of domestic violence and the birth of specialized laws, clarifying relevant terminology and legal background. Next, it provides a detailed explanation of the types and content of correctional treatment that perpetrators receive within institutions, with particular attention to the application and changes of “rehabilitative guidance.” Finally, using KUROBANE Prison as an example, the article discusses recent practical operations and concludes with some preliminary observations.
