The Theory of“Duty Relationship under Public Law”and the Right to Appeal for the Living Allowances of the Public Servant

我國有關公務員與國家關係係屬「公法上職務關係」。在公法上職務關係的理論架構下，公務員與國家關係，可分為「職的關係」與「務的關係」，公務員的各種權利、義務皆應直接引據「職的關係」或「務的關係」來作成決定。職的關係係指身分關係，係屬組織法上的問題；務的關係係指「執行職務」的關係，係屬作用法的問題。公務員請領生活津貼的權利，係基於「職的關係」的組織法上問題，與執行職務沒有關係，故在留職停薪期間或停職期間，其職的關係既未消失，自應給予各項生活津貼，此亦為公務員公法上金錢給付請求權。

The relation between public servant and state is grounded on the theory of“duty relationship under public law”. According the theory the relationship between public servant and state is categorized into two relations: the status relation and the function relation. The right to appeal for the living allowances is concerned with status relation and is not affected by the function relation. Consequently, the public servant is still entitled to receive the living allowances when his appointment is detained and the salary payment is stopped, or his duty is suspended.
