關於國家考試性別限制問題,在近年來受到各界的關注,目前,尚有六種公務人員特考設有性別限制,本文從美國經驗來探討此一問題,經分析結果,多數設有性別限制的考試並不符合兩性工作平等法的規定,許多用人機關仍存在著傳統性別差異的刻板印象。未來,各用人機關如需對於性別設限,勢必要更仔細的說明,為何不由特定性別擔任時,其工作無法或難以完成,以消除國家考試中的性別歧視及落實兩性平權的主張。
英文摘要
The issue of gender restrictions in national examinations has aroused widely concerned recently. At present, there are six examinations that are set in gender restrictions in accordance with their respective working conditions. The article examines the issue from the American experience. Its conclusion is most of the regulations that include gender restrictions are not accordance with Gender Equality in Employment Law. Most employing agencies still set gender barriers that are rooted in tradition. In the future, the employing agencies with gender restrictions on employment, will have to explain the reason that the job is unable or very difficult to be fulfilled without special gender. It is hope that with this requirement, the gender discrimination will be eliminated from national examinations and the principle of gender equality in employment will further confirmation.
