RCEP協定文本中的“權威解釋”條款的法律問題研究

Research on the Legal Issues of the ''Authoritative Interpretation'' Clause in the RCEP Agreement

近年來，“權威解釋”條款被廣泛規定於國際自由貿易協定中，但在實踐中，“權威解釋”條款的適用仍然存在對其法律效力以及實效的爭議。RCEP協定中同樣規定了“權威解釋”條款且存在效力及實效不明的問題，不利於RCEP爭端解決機制突出成員方磋商目的的實現。通過探究“權威解釋”條款效力及實效爭議，基於RCEP“權威解釋”條款現行文本，筆者提出推進RCEP“權威解釋”條款文本的完善建議，以使其更好地發揮在實踐中的作用。

In recent years, the ''authoritative interpretation'' clause has been widely stipulated in regional free trade agreements, but in practice, the application of the ''authoritative interpretation'' clause is still controversial in terms of its legal effect and effectiveness. The ''authoritative interpretation'' clause is also provided for in the RCEP agreement, and there is a problem of unclear validity and effectiveness, which is not conducive to the realization of the RCEP dispute settlement mechanism highlighting the purpose of member states' consultations. By exploring the controversy over the effectiveness and validity of the ''authoritative interpretation'' clause, and based on the current text of the RCEP ''authoritative interpretation'' clause, we propose to promote the text of the RCEP ''authoritative interpretation'' clause. The proposal is to improve the text of the RCEP ''authoritative interpretation'' clause, so that it can better play its role in practice.
