環境守法導則：一種新型環境合作治理模式

Environmental Compliance Guidelines: A New Governance Model for Environmental Cooperation

傳統的環境執法是一種威懾模式，該模式認為應該加大企業環境違法的責任，通過制裁減少環境違法，提高環境保護的效果。這是一種對抗性的治理模式，存在一定的不足，應向環境合作治理模式發展。基於合作治理理念，政府可以利用環境守法導則的形式來引導企業的生產經營活動，促進企業環境守法，這樣既減輕了環境保護成本，又提高了環境保護的績效。作為一種新型環境治理模式，守法導則體現了其合作性和有效性的特點。當然，守法導則也需要重視其合法性問題，完善相關配套制度，保證其合法性和有效性。

The traditional environmental enforcement is a deterrent mode that think we should increase corporate responsibility, in order to reducing the environmental violations and improving the effect of environmental protection by means of sanctions. This is an adversarial model of governance that has a certain lack of cooperative, and we should develop a governance model for environment cooperative. Based on the concept of cooperative governance, the government may make use of environmental compliance guidelines to guide the operation of enterprises, encourage enterprises to environmental compliance, so not only reduces the cost of environmental protection, but also  improves performance of environmental protection. As a new environmental governance model, compliance guidelines reflects its cooperation and effectiveness characteristics. Of course, compliance guidelines also need to focus on its legitimacy problem and improve related system in order to ensure its legitimacy and effectiveness.
