制度問題具有重要性，但在現代法律理論中，它卻處於語焉不詳的境地。制度法律理論在制度概念、制度規則和制度類型等問題上的研究，有助於我們從本體論上深刻認知法律制度問題。但法律制度分析也有局限性，如何統合兩種類型的法律制度，進而在一種同一的意義上來理解和實踐法律制度，是它面臨的一大難題。慣例作為一種獨特的行為標準，它的運作能夠將不同的制度類型實踐相容起來，生成一體化、整體性的法律制度。遵循恰適性運作邏輯，強化共用的制度信念，養育制度道德，凝集制度共識，並構築制度規則體系，務求夯實制度之本，構成法律制度慣例實踐的基本路徑。

In modern legal theory, institutions hold important significance, but they are not studied in details. The research on concepts, rules and types of institutions in legal theory is helpful for people to perceive legal institutions profoundly. But the analysis on legal institutions has limitations. How to integrate two types of legal institutions and then understand and put them into practice in an identical meaning is a huge challenge for legal institutions. As a special behavior standard, the operation of convention can combine different kinds of legal institutions practices into integration and globality.
There are some basic approaches to constitute the convention practic of legal system: to follow appropriate and logic operation; to strengthen the mind of sharing; to develop the morality of institution and reach a consensus; to construct the system of institution rules for purpose of consolidating the basis of institution.
