The Dilemma and Future Prospect of Indigenous Peoples Basic Law

本文說明『原住民族基本法』的立法過程以及實際推動的狀況與局限。作者認為「原基法」的權利落實應先讓部落主體擁有法律位階，推動部落公法人，如此部落內部治理的力量才可穩定。過去社運所推動的民主權利，在立法院制度內的努力落實，確實尚有很多困難。核心的概念是，原住民權益不是我們去向政府要求施捨，而是把我們原住民原有的權利恢復。 This article describes the legislative process and implementation of the Indigenous Peoples Basic Law. The author believes that the tribal public juristic persons should be given priority in the future. And the rights of indigenous peoples are not the ones we ask for to give from the government, but to rehabilitate the rights.
