當代社會的修復式正義是從原住民族傳統處理糾紛和衝突的方式發展出來的;但是對於原住民族本身來說,不見得將這樣的衝突處理模式稱作是修復式正義,而是一種生活規範,也是一種倫理關係。雖然當代研究指出修復式正義的概念是從原住民族傳統的衝突處理方式中發展出來的,可惜的是,修復式正義的研究多半是從犯罪學和被害者學的角度出發,鮮少對於原住民族傳統的衝突處理型態有深入的探討。本文以紐西蘭Māori 以及北美Diné 針對原住民族傳統的衝突處理型態做探討,從傳統、人生觀和文化的脈絡,探究原住民族修復式正義概念的本質,以及原住民族是如何凝聚或發展出這樣的衝突處理模式。
Restorative justice in contemporary society can find its roots in theways in which indigenous peoples traditionally resolve disputes and conflict.However, for indigenous peoples, such a paradigm may not be coined theterm “restorative justice,” but as a code of conduct and an ethical relation.While many current researches correctly acknowledge the origin of theso-called restorative justice as from indigenous peoples, these studies rarelydiscuss in depth how indigenous peoples dealt with conflict resolution.This paper aims to explore patterns of indigenous conflict resolution, situatedwithin traditional, life-view and cultural contexts, and examine the essenceof indigenous people’s restorative justice and how indigenous peoples cameto develop such mechanism to deal of dispute. |
