不當黨產條例「地的效力」問題

The Issue of “Effectiveness of Land” in the “Ill-gotten Properties by Political Parties and Their Affiliate Organizations”

政治學者道爾（Robert A. Dahl）主張多元民主政體的具備條件中，我們可以認知到政黨角色之重要性，而政黨的財力相當影響政黨競爭的結果。《政黨及其附隨組織不當取得財產處理條例》的通過，乃期待建立政黨公平競爭環境，健全民主政治。探討《政黨及其附隨組織不當取得財產處理條例》中「地的效力」問題，我們必須再拉高層次，釐清兩層面問題，第一個層面是「臺灣的領土主權」歸屬問題，第二個層面則為「中華民國的法律定位」問題，最終再檢視戰後中華民國政府體制，並思考如何處理1945年至1949年間，當前屬於中華人民共和國管轄區域之不當黨產。

Robert A. Dahl, a political scientist, advocates the conditions for pluralistic democracies. We can recognize the importance of the party's role, and the financial power of political parties has considerable influence on the results of party competition. The passage of the “Ill-gotten Properties by Political Parties and Their Affiliate Organizations” is expected to create a level playing field for political parties and improve democratic politics. To discuss the issue of “effectiveness of land” in the “Ill-gotten Properties by Political Parties and Their Affiliate Organizations”, we must raise the level again to clarify the issues at both levels. The first level is the ownership of “Taiwan’s territorial sovereignty”, and the second is at the same level, the issue of “legislative positioning of the Republic of China” was examined. In the end, the government system of the Republic of China after the war was examined and how to handle the improper party production that currently belongs to the jurisdiction of the People’s Republic of China from 1945 to 1949.
