兩岸政府採購招標投標法制比較及實務研究

A Comparative and Case Study on Tendering and Bidding of Government Procurement between Taiwan and Mainland China

本文旨從兩岸政府採購制度的立法目的及監督制度作介紹，對比了兩岸政府採購的招標、投標、開標制度之異同，對海峽兩岸的「政府採購法」以及大陸「招標投標法」進行比較分析及探討，以期大陸未來修訂「政府採購法」及「招標投標法」有所啟發借鑒之作用。文中首先介紹兩岸採購制度的沿革、制定、立法目的、主管機關及監管，次就兩岸的政府採購招標制度研析以及對投標與開標制度亦加以比較外，除了進一步探討兩岸評標和決標之比較外，並對大陸案例作評析，文末則提出結論作綜述；並提出對兩岸未來修法之建議。

This article introduces both legislative goals and supervision systems of Government Procurement Acts in Taiwan and Mainland China, and compares the similarities and differences on tenders, bids, and tender opening and award aspects, for suggestions on amending these Acts. First of all, this article introduces legislative history, legislative goals, government authorities and supervision approaches. Second, Compares tenders and the tender opening system on Government Procurement Act for both sides in order to explore tender evaluation and tender award. Furthermore, the mainland cases for assessment. Finally, the author provides acts amending suggestions as conclusion. Hopefully, this article can provide Taiwanese experience for Mainland China for amending Government Procurement Act in the future.
