中國大陸侵害商事物權責任問題之研究

Commercial Property Liability of Infringement

商事物權可以界定為商主體所享有的物權，即商人對特定的物所享有的直接支配並具有排他效力的權利。對商事物權的保護應以《侵權責任法》為主，《物權法》有特殊規定從其規定。商人在商事經營活動中侵害其他商人物權的，應該承擔法律責任，特殊主體也應承擔相應的責任。

Commercial Property Right is the right owned by businessmen who can control the property directly and exclude the interference from others. We can mainly protect Commercial Property Right by Tort Law. Besides, when we find some special rules in Property Law we must comply with them. Any businessmen who infringe Commercial Property Right of others should be punished by law, so do some special men in business.
