By clearing up and counting 4448 legaldocuments, the statistics shows that China has accumulated quite a few legal resources with respect to regional cooperation, including 21 articles in 15 laws, 32 articles in 25 administrative regulations, and 24 other legal documents. At present, China's legislation on regional cooperation still stays at an early stage, which means scattered articles in single laws and regulations axe continuously growing and accumulating, and at the same time a specific uniform legislation is seriously considered. Because most of the articles of regional cooperation use the conception of 'consultation', these articles can also be called as consultation articles. They could be divided as three modes, namely selective mode, procedural mode and authorized mode. No matter which mode, it has the function of excluding central government's jurisdiction on transregional affairs, and hence has the effects of expanding local government's autonomous rights and benefiting legislative power of local People's Congress. This paper believes the legal documents with respect to regional cooperation, which usually included in the National Economy and Social Development Plans enacted by the National People's Congress, also have the force of law, and shall be the important basis when presently drawing up regional plans. With no doubt, we need to keep pushing the legislative work on regional cooperation, speeding up the process of enacting a uniform law, prescribing legal mechanism and common issues in agreements of regional cooperation, and expanding local legislative autonomous rights. |
