By making a study of Quiritium law, This article concludes that Roman society before Tullius’Reform may not be primitive society, and Quiritium law is not the law of primitive society but the law of early state. Taking the genesis of state and law as a background, this article studies the emerging conditions of Roman civil law for helping people to understand the basic characteristic of modern civil law better. Finally, author oppugnes the radical conception of state and the traditional theory of five stages of social development. |
