With the rapid development of international investment, conflicts of interests arise between host states and foreign investors. The environmental measures taken by host states to protect their environment from damages of foreign investment should constitute exceptions to expropriation. Being a part of public interest of the society, environment forms the boundary of citizen’s private rights and therefore removes the illegality of some regulatory activities intervening those private rights. Taking environmental justification into consideration when deciding expropriation, it is necessary to give priority to more important interests while balancing the environmental interest of the host states and the private interests of foreign investors. |
