A Comparative Study of EU and WTO's Attitude towards Precautionary Principle

預防原則是國際法上重要的法律原則，其法律地位存在很大爭議，不同國際組織對其認可和適用的程度不盡相同。歐盟的預防原則理念領先於其他國家和地區，在區域內的實踐呈擴大的趨勢。WTO框架內預防原則的實踐則發展緩慢，由於宗旨的不同和背後利益集團的博弈，與歐盟的預防原則立法和實踐存在較大差異。Much controversy exists about the precautionary principle, one of the most important principles in international law, for different international organizations have adopted different attitudes towards it. EU is perhaps the most ardent supporter of the principle, and its notion takes the lead in the world while the notion's regional empirical usage is extending. In comparison, the precautionary principle develops rather slowly in the WTO because of aims differing and interest groups' contending, which has led to significant lag behind EU both in logic and practice.
