合作金融與政府監管存在內生的衝突,農村資金互助設的獨立自主性決定了政府對其監管應當是有限的。除非出於維護社會公共利益的需要而由政府對農村資金互助設進行監管,互助設的設立、管理與運行應當主要留給社員自行決定。實際上,農村資金互助社通過其自主制定的章程,依靠當地的習慣規範以及互助設自身的特有優勢,可以有效地進行風險管理。因此,就農村資金互助設的監管模式改革而言,我國當前銀監會的監管職能需要收縮,監管的範圍要改變,同時,農村資金互助設的自我管理能力也需進一步加強,但這些均需納入法律的框架中。Conflicts of cooperative finance and government supervision is inevitable and autonomy of rural financial cooperatives predicates limitation of government supervision. Affairs such as organization, management and operation of the cooperatives should be determined generally by members rather than government unless out of demands of protection of social interests. Indeed, rural financial cooperatives can exercise risk management effectively under self-made regulations and customs while taking their own advantages. As such, the supervisory power of the China Banking Regulatory Commission should be limited and its supervisory scope be altered. At the same time, the self-regulating power of cooperatives should be enhanced. And most importantly, all said above should be accomplished within a statutory framework. |
