中國民用核能安全保障法律制度的困境與重構

Problems of China's Legal Systems for the Safety Control of Civil Nuclear Energy and the Possible Solutions

民用核能是一種清潔、高效的能源。頻發的民用核能事故要求在民用核能利用過程中重點關注安全保障法律制度建設。民用核能利用的生態倫理及民用核能安全價值是構建民用核能安全保障法律制度的理論基礎。我國民用技能安全保障法律制度在立法理念、法律體系、法律制度實施等領域均存在困境。借鑑國外民用核能安全保障法律制度建設的經驗，中國應該從法律程序、實體法、相關制度等方面對民用核能安全保障法律制度加以重構。Civil nuclear energy is a kind of clear and efficient energy, but the frequent occurrence of civil nuclear accidents shows that much attention should be paid to the legal systems for the safety control when using civil nuclear energy. Ecological ethics and safety control are the theoretical foundations for the building of such legal systems. China's concerned legal systems are facing some knotty problems in the realm of legislative ideas, institutional systems and the implementation of institutions. From the experiences of other countries, we shall try to rebuild China's legal systems for the safety control of civil nuclear energy from the perspective of legal procedures, substantive law and concerned institutions.
