區域協同視域下長三角生態一體化的法治進路

The Rule of Law Approach to Ecological Integration in the Yangtze River Delta from the Perspective of Regional Cooperation

在長三角一體化上升為中國大陸國家戰略的背景下，三省一市為促進生態環境的共保聯治做出了諸多探索，特別是在區域環境治理協同立法、跨區域聯合執法和統一司法裁判規則等方面進行了有益的探索；但是仍存在著跨區域組織協調機構定位與職權不匹配、區域協同立法缺乏深層次協調、聯合執法缺乏法治保障和司法裁判規則不統一等不足。因此，應當以區域協同治理的思維統籌長三角生態一體化的法治進路，完善一體化組織協調機構職能、建立區域協同立法工作機制、深化跨區域協同執法體制改革、推動一體化司法協同機制建設，為長三角生態一體化提供法治保障。

In the context of the rise of the integration of the Yangtze River Delta as a national strategy in mainland China, the three provinces and one city have made many explorations to promote the joint protection and governance of the ecological environment, especially in the areas of collaborative legislation for regional environmental governance, cross regional joint law enforcement, and unified judicial rules; However, there are still shortcomings such as the mismatch between the positioning and authority of cross regional organizational coordination institutions, the lack of deep coordination in regional collaborative legislation, the lack of legal guarantees for joint law enforcement, and the inconsistency of judicial judgment rules. Therefore, the rule of law approach for ecological integration in the Yangtze River Delta should be coordinated with the thinking of regional collaborative governance, improving the functions of integrated organizational coordination institutions, establishing regional collaborative legislative mechanisms, deepening cross regional collaborative law enforcement system reforms, and promoting the construction of integrated judicial collaborative mechanisms to provide legal guarantees for ecological integration in the Yangtze River Delta.
