Due to the worldwide financial crisis of 2008, many countries are forced to review their financial supervision mode and financial consumer protection. Countries successively establish the financial consumer protection mechanism in order to maintain the stability of the financial market. Concerning processing financial consumer disputes, in the Taiwan area, the Republic of China has legislated related acts to protect the rights and interests of financial consumers, and organized a non-government agencies to handle financial consumer disputes. However, there are no such exclusive acts of the financial consumer protection in the Mainland area to effectively handle financial consumer disputes. Therefore, this article will expound the Financial Consumer Protection Act and the processing mechanism of financial consumer disputes currently implemented in the Taiwan area as references to the future legislation in the Mainland area. When the two sides across the strait have established a sound processing mechanism of financial consumer disputes, they may further handle crossborder financial consumer disputes by cross-strait cooperation, and certainly protect the rights and interests of financial consumers. |
