As the significant growth of C2C online transactions, the third-party payment service provider - such as Paypal in US and Alipay in China- plays an important role that assists the payment and secures the performance of contracts. However, among these emerging third-party payment services, most of the legal relations between providers and users rely on the standard terms and conditions which are unilaterally set by the providers. Hence the providers may transfer the transaction risks to consumers by these standard terms and conditions. This article is tending to figure out whether there are reasonable and adequate measures to protect consumers in the regulations, “Mandatory and Prohibitory Provisions of Standard Contracts to Be Used for the Third-Party Payment Service” and “The Act Governing Electronic Payment Institutions,” which were promulgated respectively at 2014 and 2015.
