The Conservation and Management Regime of Straddling and Highly Migratory Fish Stocks

論文的目的在於闡明1995年魚種群協定所建置的跨界與高度洄游種群保育與管理制度。1995年魚種群協定仍然植基於傳統的漁業保育觀念，但卻融人生態系方法。1995年魚種群協定所植基的原則之一是合作原則。公海捕撈國與相關沿海國應在跨界與高度洄游種群的保育與管理方面，直接或透過次區域或區域漁業管理組織或安排，進行合作。公海捕撈國應在保育與管理措施的實施與執法方面，進行合作。

The purpose of the article is to elaborate the conservation and management regime established by the 1995 Fish Stocks Agreement for straddling and highly migratory fish stocks. The 1995 Fish Stocks Agreement still bases on the traditional fisheries management concept but integrates ecosystem approach into it. One of the fundamental principles which underpin the 1995 Fish Stocks Agreement is principle of cooperation. High seas fishing states and relevant coastal states shall cooperate, either direct1y or through subregional or regional fisheries management organization or arrangement in the conservation and management of straddling and highly migratory fish stocks. High seas fishing states are obliged to cooperate in compliance and enforcement of conservation and management measures.
