現今的校園強調友善與人權環境的建立,對學生隱私權的尊重就是在落實友善校園人權環境,然而在中小學的教育現場中,侵犯學生隱私權的案例層出不窮,其中不乏是教師專業自主權與學生隱私權發生衝突,有學生為了捍衛其隱私權,甚至向司法機關提起訴訟。由於中小學教師專業自主權與學生隱私權的對立衝突,導致師生間的情感與信賴關係破裂,對學校人權教育造成莫大的傷害,也影響教育的進行,無助於學生健全人格的發展與品德的陶冶。因此,解決教師專業自主權與學生隱私權衝突的發生,維持師生間和諧,乃當務之急。故本文首先探究中小學教師專業自主權及學生隱私權之憲法上地位。其次,分析基本權利衝突的解決理論。最後,就教師專業自主權與學生隱私權衝突進行調和。
英文摘要
Present-day campuses emphasize the establishment of a campus environment that is friendly to human rights. In fact, the respect for student privacy is the realization of a campus environment friendly to human rights. However, in the educational context of secondary and elementary schools, there are many cases of intrusion on student privacy. Many cases involve the conflict between teachers’ professional autonomy and student privacy. The opposition and conflict between secondary and elementary school teachers’ professional autonomy and student privacy destroy emotions and trust relationships between teachers and students, greatly damaging the human rights education at schools, affecting the progression of education, and do not help the development of healthy personalities and cultivation of virtues. Thus, resolving the conflict between teachers’ professional autonomy and student privacy to maintain teacher-student harmony is an urgent issue. Based on the above, this study conducts literature review to explore the constitutional position of secondary and elementary school teachers’ professional autonomy and student privacy, and analyzes the theory for resolving the conflict of fundamental rights. Finally, this study reconciles the conflict between teachers’ professional autonomy and student privacy.
