I am aspecialist in hematology and oncology who has been practicing for nearly 30 years. Ihave seen and experienced ups and downs in the medical field, and Ihave been thinking deeply about what the ’’bottom line’’ of ’’medical behavior’’ is? ’’Medical ethics’’ and even ’’Hippocrates’’. The ’’Hippocratic oath’’ (Hippocratic oath) is the ’’standard answer’’ used by the medical profession as amantra. However, these are not the answers that can convince the ’’introspective’’ doctor. The result of my deep thinking is that the ’’law’’ is the ’’bottom line’’ of ’’medical behavior’’, and the ’’bottom line’’ of ’’medical behavior’’ can only be clearly portrayed through the medical litigation of ’’equity of arms’’. Just like the dialogue in the Japanese drama ’’White Tower’’: ’’I think the court is not aplace to condemn doctors, but aplace to make medical progress. If doctors worry too much, they will not be able to make medical progress. In case of unfortunate results, doctors should accept it calmly, and investigate the reasons, medical treatment can improve, and the court is such aplace.”Therefore, my motivation for studying in the law institute is to obtain the qualification to apply for the college entrance examination for lawyers, and Ialso look forward to becoming amedical litigator with double majors in medical law in the future. With this master’s dissertation to get amaster’s degree, Iwant to get alawyer’s license and become alawyer, Iwant to improve future medical litigation to fairness and justice as the statement of this thesis. |
