New Development of the Nuclear Safeguards Legal Framework in the European Union

在歐洲聯盟之架構下，歐洲原子能共同體的任務之一，在於確保核物料不被轉用於其原定用途以外之目的。基此，歐洲原子能共同體建立一套自身之核子保防體系，與國際原子能總署之核子保防制度非常類似。本文擬探討歐盟／歐洲原子能共同體所建構之核子保防體系與相關法律規範，尤其是歐盟執委會於2023年底所提出之核子保防規則修正草案，值得關注。

Under the structure of the EU, it is one of the tasks of the Euratom to make certain that nuclear materials are not diverted to purposes other than those for which they are intended. The Euratom sets up its own system of safeguards, very similar to the one under the IAEA. This article aims to explore the EU/Euratom nuclear safeguards system and legal framework, especially the proposal for a new (revised) Commission Regulation on the application of Euratom safeguards which is worthy of attention.
