This article aims to elucidate the framework of the vendor selection system under Taiwan’s Government Procurement Act (hereinafter referred to as the “Procurement Act”) and to accentuate the main issues encountered at various stages of the vendor selection process. To achieve this, it is first essential to clearly grasp the legislative intent and overall structure of the Procurement Act, thereby understanding the objectives of the government procurement vendor selection system and its contextual background. The framework of the government procurement vendor selection system is primarily composed of the arrangements and choices among different tendering methods, the determination of the specifications for procurement items and the qualifications of participating vendors, as well as the selection of award criteria, whether based on the lowest bid or the most advantageous bid. While this article primarily focuses on elaborating on the institutional arrangements for vendor selection under Taiwan’s Procurement Act, it also refers to relevant discussions in German legal frameworks for comparative purposes. |
