The Intellectual Property Case Adjudication Act was amended on January 12, 2023, which is the most drastic amendment in the 14 years of its implementation and had brought important changes to trade secrets litigation, such as: adoption of mandatory legal representation; adoption of exclusive jurisdiction of civil and criminal case to the Intellectual Property and Commercial Court; expanding the scope of the applicant for a protective order and raising the criminal liability; the clarification of the data prohibition and restriction of access to the files, and the method of de-identification; and add the system of verifier to balance the burden of proof. Since this amendment has made some breakthroughs in related practical issues, the new act has been in effect for more than a year, there are still some imperfections, and we are looking forward to suggestions from all sectors of the community based on the practical operation of the new act in the future. |
