智慧財產案件審理法修正下對於專利及商標救濟對審制優化之期許

The Expectation on the Refining System for Inter Parte Review of the Validity of the Patent and the Trademark After the Recent Amendment of Taiwan Intellectual Property Case Adjudication Act

我國自智慧財產法院創立以來，對專利權或商標權效力爭議，採取雙軌制之建構，因此對審制未來之實現不僅攸關專利權或商標權效力爭議解決制度之優化，更關係著與民事侵權訴訟間之互動與協力，如何全力促成對審制在我國生根並開花結果，實為當務之急。本文由對審制「本體之形成」與「效力」二方面，評論我國專利法與商標法關於對審制建構之修正草案，並提出建議。關於對審制與雙軌制間之互動與協力，本文再次強調「雙軌效力競合制」之構想。

This Article delivers the comments on the bills of the amendment of Taiwan Patent Act and Taiwan Trademark Act that propose the Inter Parte review system of the validity of the patent as well as that for the trademark, according to the observation of the systematic structure and the execution effect. Regarding the interaction and collaboration between the aforesaid the Inter Parte review system and the parallel systems for the invalidity, this article proposes the model of the competition of the legal effect for the parallel systems of the invalidity.
