This paper conducts a comparative analysis of Australia’s News Media and Digital Platforms Mandatory Bargaining Code and the proposed Taiwan’s News Media and Digital Platforms Mandatory Bargaining Act. In the digital era, the rise of large platforms presents challenges to the survival and transformation of traditional news media. To protect free speech, market competition, and the supervisory role of news media over governments, countries globally are formulating strategies. Australia’s News Media and Digital Platforms Mandatory Bargaining Code has become a key focus. Taiwan’s news industry faces a similar dilemma, with proposals such as the drafted version of Taiwan’s News Media and Digital Platforms Mandatory Bargaining Act being presented and considered by legislators, drawing inspiration from the Australian model. The initial chapter introduces the issues of news media bargaining and the digital transformation challenges faced by Taiwan’s news media. The second chapter provides an in-depth analysis of Australia’s News Media and Digital Platforms Mandatory Bargaining Code, covering its legislative background, objectives, regulatory content, and implementation overview. The third chapter focuses on Taiwan’s proposed draft version of the News Media and Digital Platforms Mandatory Bargaining Act, comparing it with the Australian legislation and exploring the insights Australia’s experience may offer to Taiwan. The paper concludes by discussing the potential for establishing a media bargaining system in Taiwan. |
