Although Act Governing the Use of Police Weapon has been revised five times, as political, economic, and social changes have become more and more complicated, the magnitude of the revisions has not kept up as time goes by. In addition, the police’s weapon on duty has not been equipped with technological one along with the advancement of science and technology. As a result, the lack of weapon on duty has caused many regretting events. Therefore, to reconstruct a complete legal system for the management of electrical police weapon, this article first analyzes the basic human rights guarantees involved in the management of electrical police weapon and then discusses external and internal management standards. At the same time, the feasibility analysis of the use of electric stun guns by police officers is carried out. The external management standards discussed in this article include the use of electrical police weapon, the management of electrical police weapon manufacturers, and the state responsibilities of police personnel after the use of electrical police weapon. As for the internal management standards, they include establishing internal control standards (Including reports on the use of police weapon by the police, general weapon specifications, and budget), and the establishment of an investigation team for disputes over the use of police weapon. After a comprehensive analysis, conclusions are drawn, and legal recommendations were put forward to construct a complete legal system for electrical police weapon management. |
