This article is the text of a speech delivered by Professor Daisuke Midori at the Criminal Law Week seminar at National Chengchi University on March 9, 2023, and was subsequently revised and submitted to this journal by Professor Midori. The article focuses on how the court utilizes the results of the Sentencing Retrieval System when measuring penalties under the Japanese referee system, and how to deal with the situation in which there is a discrepancy between the sentencing and the sentencing tendencies. This article also points out explicitly the problems that have occurred or may occur in the future in the application of the sentencing retrieval system and the situations that cannot be addressed by the sentencing retrieval system. While the Citizen Judges Act in Taiwan has come into effect this year, related issues may also occur in the future citizen judges trial. As the author mentioned at the beginning, the introduction of this discussion in Japan may be a valuable reference for the future judicial practice and legal theory in Taiwan. |
