在華留學生法治課程的功能審視與路徑探析

On the Function and Path of Law Curriculum for International Students in China

在華留學生法治課程的應然目標是促使在華留學生用比較和理解的態度看待不同法治實踐之間的异同，進而能夠以一種審視與反思的視角去對待國家之間法治的差异，深刻理解各國法治的本土價值，在交流中產生互信。法治課程應以英語作為課程語言，以國際公認的法律文本之官方英文翻譯作為教學的主要資料。在華留學生法治課程的教師應首先重點講述本土化的法治知識，在此基礎上，運用法理實現法治知識普遍性與本土化的耦合，促使在華留學生形成對本土化法治知識的充分理解與尊重，進而樂于并善于促進不同法治文化之間的持續交流。

The expected goal of the law curriculum for international students in China is to promote the students studying in China to look at the similarities and differ-ences between different rule of law practices with a comparative and understanding atti-tude, and then to treat the rule of law differences between countries from a perspective of examination and reflection, deeply understand the local value of the rule of law in various countries, and generate mutual trust in exchanges. The law curriculum should take English as the course language and the official English translation of internationally recognized legal texts as the main teaching materials. The teachers of the law curriculum for the students in China should first focus on the local knowledge of the rule of law, on this ba-sis, use jurisprudence to realize the coupling of the universality and localization of the knowledge of the rule of law, so as to promote the full understanding and respect of the local knowledge of the rule of law for the international students in China, and then be will-ing and good at promoting the continuous exchange of different culture of the rule of law.
