Evaluation and Prospects of the Civil Code in Mainland China from a Codicological Perspective

從法典學的觀點來看中國大陸2020年通過的民法典，會發現體系化不足是它最大的問題，偏偏體系化已經是今天民法典存在的主要價值。儘管部門取向的體系化也能帶來一定的體系效益，且政治上有較高的可行性，但往長遠來看，其教義學勢將承擔特別高的成本。此外，中國大陸沒有善用這百年才有的法典時刻，也錯失了在潘德克頓法學的基礎上做重大創新而引領21世紀民法典風潮的機會，十分可惜。

Looking at the civil code to be adopted in 2020 in mainland China from a codicological point of view, one finds that its lack of systematization is its biggest problem, even though systematization is already the main value of the civil code’s existence today. Although a sectoral approach to systematization can also bring some sys-temic benefits and has a high degree of political feasibility, its doctrinal potential will be particularly costly in the long run. Moreover, mainland China did not make good use of the “code moment” that only exists in this century, and has missed the opportunity to make major innovations on the basis of Pandekten Legal Science to lead the trend of civil code in the 21st century, which is a great pity.
