Looking at the civil code to be adopted in 2020 in mainland China from a codicological point of view, one finds that its lack of systematization is its biggest problem, even though systematization is already the main value of the civil code’s existence today. Although a sectoral approach to systematization can also bring some sys-temic benefits and has a high degree of political feasibility, its doctrinal potential will be particularly costly in the long run. Moreover, mainland China did not make good use of the “code moment” that only exists in this century, and has missed the opportunity to make major innovations on the basis of Pandekten Legal Science to lead the trend of civil code in the 21st century, which is a great pity. |
