由都市計畫新典範及治理觀點評析土地使用分區管制法律－－以苗栗大埔事件為例

The Comment on Zoning Laws in the View of New Paradigm and Urban Governance of Urban Planning: Take the Miao-li Da-pue Event as An Example

在後國家時期，各國城市致力提升全球競爭力，因之城市治理成為備受重視的研究議題。另因環境資源與文化不同，一國城市如何發展出自我定位及特色，並與其他城市競爭合作，便成為治理過程中必須思考及處理的重要問題。以我國為例，新竹因大學與科學園區而發展成科技城市，反觀北鄰竹科竹南基地的苗栗縣，則計畫將大埔里23公頃土地劃為都市計畫使用，藉以帶動地方經濟發展，惟與居民未談妥補償條件，加上更改計畫徵收範圍，以致引發社會爭議。針對以高科技發展經濟之名的苗栗大埔事件，本文試從都市計畫新典範的城市治理觀點檢視土地使用分區管制法律，並指出我國土地使用分區管制的法律爭議問題，最後建議地方政府應該瞭解出於開發建設傳統思維的都市計畫方案，實則悖於永續發展精神，以利提升城市治理的正確認知。

In post-nation-state period, the cities of every country were committed to enhance its global competitiveness and then urban governance became a highly-important research issue. Due to different environmental resources and culture, how a city to develop its self-positioning and characteristics and compete with other cities became the important problem needed to think and deal with in the governance process. Take our country for example, Hsin-chu developed into a technopolis with the universities and the Science Park. In contrast, Miao-li County planned to zone 23 hectares of land located in Da-pue for urban planning and to develop local economy. Because the Miao-li County and local residents didn’t reach an agreement about the terms of compensation and changed the scope of the plan, so that lead to social controversy. As to the Da-pue event in the name high-tech to develop economy, this paper tried to comment on Taiwan’s zoning laws in the view of new paradigm and urban governance of urban planning, and pointed out the legal issues of land use control in Taiwan. Finally, we suggested that the local government should realize the urban plan with traditional thinking concerning development and construction didn’t meet with the spirit of sustainable development, so as to enhance their staffs to understand urban governance correctly.
