Adjudicative jurisdiction is the logical starting point for the extraterritorial reach of the U. S. domestic law. By flexibly applying jurisdictional rules, U.S. courts not only facilitate private enforcement of public law norms and international law, but also go beyond traditional dispute resolution to engage in foreign relation affairs. In this process, procedural mechanisms such as discovery embed the U. S. legal standards and policy preferences into global commercial activities, turning adjudicative jurisdiction into a key institutional vehicle for projecting domestic legal standards and policy influence overseas. Consequently, the exercise of adjudicative jurisdiction produces a significant foreign relations participation effect. China's overseas interests have become far more diverse, yet adapting to the concept of extraterritorial adjudicative jurisdiction remains a work in progress. China has largely completed the institutional groundwork for effectively exercising extraterritorial adjudicative jurisdiction and has accumulated practical experience, laying foundation for practicing a proactive approach to extraterritorial adjudicative jurisdiction. Optimizing the system of extraterritorial adjudicative jurisdiction serves as a key bridge between domestic rule of law and foreign-related rule of law, and as an important lever for China to protect its national interests. |
