技術及職業教育法修正芻議

The Propositions toward Revising the Technical and Vocational Education Act

藉由長期觀察、文件分析及焦點團體座談方式，本文先就《技術及職業教育法》之立法歷程、草案研擬重點及完成立法後之法律結構、內涵，予以陳述後，再綜整《技術及職業教育法》施行10年期間所遭遇之問題，共計提出18項問題；而針對18項問題，本研究參考美國2018年修正公布《因應二十一世紀職涯及技術教育強化法》、德國2020年修正公布《職業教育法》，及2025年我國行政院公告第五版〈技術及職業教育政策綱領〉之內容，提出10項修正方向。希冀透過此10項修正方向，能逐步修正《技術及職業教育法》，俾利我國技職教育制度之佈建，得經由完備法規範，發揮兼顧國內需求功能及國際發展趨勢，並能形塑我國技職教育之獨特性。

Through long-term observation, document analysis, and focus group discussions, this paper first delineated the legislative background of the Technical and Vocational Education Act, including the key emphases during the drafting process as well as the legal structure and substantive content following its enactment. Subsequently, it synthesized the issues encountered during the ten years of implementation of the Act, identifying a total of eighteen major issues. In response to these issues, this study drew upon the 2018 amendment of the Strengthening Career and Technical Education for the 21st Century Act in the United States, the 2020 amendment of the Vocational Training Act in Germany, and the Fifth Edition of Taiwan’s Technical and Vocational Education Policy Guidelines announced by the Executive Yuan in 2025, to propose ten directions for legal revision. It is anticipated that, through these ten proposed revision directions, the Technical and Vocational Education Act can be progressively refined, thereby facilitating the systematic development of Taiwan’s technical and vocational education system. With a comprehensive legal framework in place, the system may better address domestic needs while aligning with international development trends, and ultimately shape the distinctive characteristics of Taiwan’s technical and vocational education.
