家長主義與有瑕疵的被害人決定

Paternalism and Deficient Victim Decisions

本文的研究對象是家長主義與有瑕疵的被害人決定之間的關係，以及德國《刑法》第216條“受囑託殺人罪”和第228條“被害人同意”的合法性基礎。首先，本文論述了家長主義與法權自由的關係，認為現代法治國家應當尊重個人自我決定權，國家不能以為了當事人的利益為名，通過硬家長主義的方式限制個人決定。其次，本文認為，可以通過軟家長主義的方式來保護個人的長遠利益，即如果個人決定嚴重偏離了他自己的標準，國家就應當出面糾正。最後，本文以軟家長主義為基礎，主張德國《刑法》第216條和第228條的合法性基礎在於瑕疵決定風險。當被害人委託他人殺死自己或“違背善良風俗地”傷害自己時，其決定存在瑕疵風險，故而應當否定其承諾效力。
