工作秘密屬於《政府信息公開條例》第１４條規定的“法律、行政法規禁止公開的政府信息”，它首先被《公務員法》和《公職人員政務處分法》所規定，但上述法律並未界定其內涵。工作秘密是指國家秘密之外的，關係到本機關、單位的公務活動的運行，經正式程序確定，在一定時間內只限一定範圍的人員知悉的事項。工作秘密與內部事務信息、過程性信息、行政執法案卷信息有所交叉，但並非所有的內部事務信息、過程性信息、行政執法案卷信息都屬工作秘密，只有不能公開的內部事務信息、過程性信息、行政執法案卷信息才是工作秘密。與政府信息公開行政訴訟中對國家秘密僅作形式審查不同，工作秘密的定密權雖然在行政機關或者本單位，但法院應當對其進行實質審查，即公開該信息是否會對本機關、單位的公務活動造成損害，並且要與公眾監督的價值進行衡量。

Worksecretsbelongtothe"governmentinformationprohibitedbylawsandadministrativeregulations"stipulatedinArticle14oftheRegulationsontheDisclosureofGovernmentInformation,ItisfirstregulatedbytheCivilServantLawandtheGovernmentSanctionsLaw,buttheabovelawsdonotdefineitsconnotation.Worksecretsrefertomattersotherthanstatesecrets,whicharerelatedtotheoperationoftheofficialactivitiesoftheorganorunit,andaredeterminedbyformalproceduresandareonlyknowntoacertainrangeofpersonnelwithinacertainperiodoftime,Worksecretsover-lapwithinternalaffairsinformation,processinformation,andadministrativelawenforcementcasefileinformation,butnotallinternalaffairsinformation,processinformation,andadministrativelawenforcementcasefileinformationareworksects.Differentfromtheformalexaminationofstatesecretsintheadministrativelitigationofgovernmentinformationdisclosure,althoughtherighttoclassifyworksecretsrestswiththeadministrativeorganortheentity,thecourtshouldconductasubstantiveexaminationofit,thatis,whetherthedisclosureoftheinformationwillaffectthesecrecyoftheorganorentity.Officialactivitycausesdamageandisweighedagainstthevalueofpublicscrutiny.
