The recognition and enforcement of Court of Arbitration for Sport appeal awards under the New York Convention may face the obstacle of commercial reservation. At the same time, after the revision of China’s Sports Law, a strict distinction has been made between the scope of sports arbitration and commercial arbitration, thus, the appeal awards containing economic rights and obligations may not be recognized and enforced. In this regard, we can draw on the monetary value method and the commercial and property interest interpretation in Swiss and American trial practice to determine the options for recognising and enforcing appeal awards from the perspective of clarifying whether or not the appeal award involves economic rights and obligations: generally recognizing and enforcing appeal awards arising in professional sports; selectively recognising and enforcing appeal awards in amateur sports that are closely linked to professional sports or commercial activities; and adjusting the monetary value method to exclude appeal awards that do not arise out of disputes over economic interests. |
