實施「高級中等以下學校教師解聘不續聘停聘或資遣辦法」後,若學校有管轄事件應召開校事會議,釐清事件以保障學生受教權與顧及教師工作權。校事會議屬於新興業務,此辦法良善立意,卻因辦理期程長和支付經費多,影響全校師生,造成有違公平性。本研究針對行政效能與學校經費提出改善處置,就行政效能而言,應1.承辦人員加強教育訓練、2.處理期程的調整、3.承辦人員加強知識管理;就學校經費而言,應1.當事人部分負擔、2.匿名案不應列入受理範圍、3.專款全額補助。最後教育主管機關應透過調整協助學校解決問題,並對教師加強法治教育宣導,暢通親師生溝通管道,落實教師輔導機制。
英文摘要
With implementation of the ''Regulations on Dismissal, Non-Re¬newal, Suspension or Layoff of School Teachers at Senior High School Level or Below'', if there is an incident belongs to school's jurisdiction, a campus incident resolution council should be held to clarify the incident to protect students' right of education and teachers' right of work. Cam¬pus incident resolution council is a new affair for school administration. This regulation has good direction. However, due to the long processing period and large payment funds, it causes unfairness to teachers and stu¬dents. The study proposes ways to improve administrative efficiency and school funding. For administrative efficiency, it is necessary to enhance educational training for officers, adjust the administrative schedule, and strengthen knowledge management of officers. For school funding, it is necessary to pay part of the payment by litigant, refuse anonymous cas¬es, and provide full subsidy for applications. Finally education authority must assist schools to solve problems, promote legal education to teach¬ers, smooth communication channels between teachers and students, and implement the guidance mechanism of teacher.
