2019 /452 /Eu and a series of supporting documents have established a dual foreign direct investment security screening mechanism for EU's Member States. The Regulation is highly targeted to China. The establishment of it brings challenges for Chinese enterprises investing in Europe, such as increased difficulty in investment access, increased risk of trade secret leakage, and lack of judicial remedies- In this regard, Chinese enterprises can respond at both the enterprise and national levels. At the enterprise level, Chinese enterprises should establish an internal investment supervision system; make good use of EU investor remedies; change the investment strategy and make coinvest ments with investors from other countries. At the national level, China should actively promote the signature of the CAI, adding investment facilitation measures to protect the equities of investors. |
