Towards Diversity: Systems Theory as a Methodology in International Law

面對百年未有之大變局，中國國際法學界應當更加深入地思考國際法方法論問題。方法論的變革，往往是國際法研究範式變革的前奏。在討論“全球化”時，國際法的研究範式往往定位於主體“國家”之上，分析與經濟、法律全球化等相伴的各種“去國家化”問題。當代社會系統論法學大師貢塔．托依布納從“社會憲治”理論中獲得核心啟發，試圖以一種超越國家－政治中心色彩的範式觀察各種與“全球化”相關的新興現象，可在“國家的離開→國家的回歸→國際法的未來”三階段行動軌跡等經典敘事之外，增添一種方法視角，為國際法學者範式轉型提供一種法社會學進路，也為中國國際法提供超越傳統西方中心主義視角下國際法方法論侷限的一些啟示。

Experiencing a transformative era unparalleled in the last century, the Chinese international law community should delve deeper into the methodological underpinnings of international law. Transformations in methodology frequently herald paradigm shifts within the field of international law. In discussions on 'globalization', international law's research paradigms commonly elevate the 'nation-state' as a primary subject, examining various 'denationalization' phenomena that arise alongside economic and legal globalization. Gunther Teubner, an eminent scholar of sociological jurisprudence, drawing pivotal inspiration from the theory of 'societal constitutionalism', endeavors to observe the myriad emerging phenomena associated with 'globalization' through a paradigm that transcends state-centric and political perspectives. This novel approach not only adds a methodological dimension beyond the classical narratives of 'the departure of the state→the return of the state→the future of international law', but also paves a sociological legal pathway for the transformation of paradigms among international law scholars. Furthermore, it provides insights that challenge the limitations of traditional Western-centric views on international law methodologies.
