When exploring the licensing and fee calculation mechanisms for the use of musical works and sound recordings by college radio stations, the U.S. system offers highly valuable insights. This article aims to learn from the U.S. experience, beginning with an overview of the history and operational structure of U.S. college radio stations. The article will then introduce the basic concepts of U.S. copyright law, the types of copyrighted works and rights involved in the use of songs by college radio stations, and the statutory royalty calculation provisions in the Copyright Act. The focus will then shift to the practical aspects of royalty fee calculation for the use of musical works and sound recordings by college radio stations, including the statutory methods outlined in the Code of Federal Regulations, as well as other negotiated methods. Finally, this article seeks to reflect on and evaluate the college radio fee calculation system in Taiwan based on the U.S. mechanisms, and offer suggestions for improvement. |
