論大學廣播電台音樂與錄音著作使用問題：以文化政策與文化公民權觀點為核心

On the Use of Music and Recording Works on University Radio Stations: The Cultural Policy and Cultural Citizenship Perspectives

大學內的廣播電台作為教學資源之一環，提供學生實習，透過節目製播與聲音傳送於特定區域內，同時兼具教育，以及社區文化資源共享兩大功能。但在節目製作過程中採用的音樂及錄音著作，依照現行法令，卻無法因為學生學習的教育目的，以合理使用來取得授權。考量付費成本因素，憂心涉及侵權，影響所及，在實務上，各大學校園內的廣播電台紛紛避免使用音樂與錄音著作，無形之中對文化創造產生負面效果，間接危及學生的學習。
《世界人權宣言》主張第27條：「人人有權自由參社區的文化生活、享受藝術，以及分享科學進步及其果實。」大學廣播電台同時具有社區資訊傳播、創造社群文化，以及提供學生學習等功能，得以強化民眾之文化藝術活動參與、媒體近用，建構文化公民權的重要環節之一。但在廣播電台音樂與錄音著作的公開播送、公開傳輸等權利的節制影響下，是否可能是消極地減損文化公民權。故本文以文化政策與文化公民權的角度切入分析，試著為非營利的教育目標與文化創作、參與和近用之間的討論，搭建起橋樑。

As a part of the teaching resources, the radio station in the university provides students with internships. The universities radio station has two major functions: education and community cultural resource sharing. However, according to current laws and regulations, the music and sound recordings used in the production cannot be authorized for fair use for the educational purpose of student learning.
The ''Universal Declaration of Human Rights'' Article 27: '' Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.'' However, because of restrictions on the public broadcasting and transmission of music and sound recordings by university radio stations, the cultural citizenship rights might be negatively diminished. Therefore, this article analyzes it from the perspective of cultural citizenship and tries to build a bridge between the non-profit educational goals and cultural creation, participation, and use.
