我國卸任國家元首禮遇法制之演變及相關問題探討   全文下載

The Development and Research on Legislation of Courtesy of Former Presidents and Vice Presidents

立法院第6屆第3會期之臨時會通過「卸任總統副總統禮遇條例」修正案，對我國卸任國家元首禮遇之法制化有所貢獻。惟第本次修法極為倉促，完全透過黨團協商成案，以致部分修正條款情緒性及針對性太高，難謂周全，實有再進一步檢討修正之必要。本文經詳加探討制度之演變及研析修法後值得改進之問題，並逐一提出修法建議，供各界研究參考。

The third session of the sixth Legislative Yuan approved an amendment of the Act on courteous treatment for former-presidents and vice presidents. The amendment has its contribution to the legitimation of courteous treatment for former-presidents and vice presidents, but the legislative process of this amendment was so hastily, finally by means of party negotiation, that there are too emotional and specific on some articles of the amendment. Therefore, it can not be regarded as a comprehensive act and is necessary to consider another amendment. My study has researched about the development of the courtesy system and the problems needed to be resolved for the amendment of the Act. Finally I also make some suggestions for those problems.
